1.1. This website is owned and administered by the Treasury.

1.2. These terms and conditions ("Terms") govern the use and access by any user of the Board Appointments Database website at boardappointments.co.nz ("Website"). If you access and use the Website you are deemed to have agreed to these Terms and our Privacy Statement.

1.3. In these Terms, references to "we" "us" and "our" means the Treasury, and includes, as the context requires, its employees and agents.

1.4. Reference to "user" "you" "your" and "yours" shall mean any user who is accessing the site at any time.

1.5. If you wish to apply to register as a user of the Website you will be required to logon via the RealMe login service.

2. Purpose

2.1. The Website gives you the opportunity to provide your personal information to assist the Treasury with considering you for appointments to the boards of the entities monitored by the Treasury.

2.2. Further, where you have authorised us to do so in your account settings:

a. the Treasury’s partner agencies may access and use your information to consider you for board positions supported by these partner agencies; and
b. the Treasury may nominate you to be considered for governance roles at other organisations.

3. Changes to these Terms

3.1. We may amend these Terms from time to time. We will notify changes by posting the amended Terms on the Website and the changes will be effective from the date and time they are posted. In addition, we may notify you of any material changes to our Privacy Statement.

3.2. You are responsible for reviewing these Terms and the Privacy Statement. Your continued use of this Website after any such amendment constitutes your agreement to the amended Terms and/or amended Privacy Statement.

4. Information Provided by Users

4.1. The Treasury is not responsible for checking or validating any information you provide. You agree to ensure, and warrant that material or information you provide on the Website:

a. is genuine;
b. is not misleading or deceptive;
c. complies with all laws;
d. does not infringe the intellectual property rights of any person;
e. is not defamatory, obscene or otherwise inappropriate; and
f. does not adversely affect the goodwill and reputation of Treasury or any other member.

5. Password Security

5.1. We recommend that the password you select should not relate to any readily accessible data such as your name, birth date, address, telephone number, driver's licence, licence plate or passport. Nor may it be an obvious combination of letters and numbers, including sequential or same numbers or letters. Your obligations in relation to keeping your RealMe login safe are described in the RealMe Terms of Use. Treasury shall not have any liability for your failure to comply with these obligations.

6. Security

6.1. The services are provided through a secure website. You acknowledge and agree that internet transmissions are never entirely secure or private, and that any message or information you send to or through the Website may be read or intercepted by others, even where a website is stated as being secure. Treasury shall have no liability for the interception of information through the Website by unauthorised third parties.

7. Ownership of Intellectual Property and Restrictions on Use of Website Material

7.1. Unless otherwise stated, the information available on or through this Website is protected by copyright. The information may be reproduced for personal or in-house use without written consent, so long as you:

a. acknowledge the source and copyright status of our information;
b. do not alter any material or use it in a misleading manner; and
c. do not reproduce (without written consent) the website’s design elements or any government or other organisation’s emblems or logos.

7.2. Please contact us for written consent to reproduce the information for any other purpose. Where the information is the copyright of a third party, you will need to contact the copyright holder directly for such consent.

c. to test the vulnerability of the Website or any network connected to the Website, or seek to trace any information on any other user of the Website.

10.2. We may, at any time and without prior notice or any liability to you, change, suspend, restrict or terminate your access to this Website or any part of it for any reason including for any breach of these terms.

11. Governing Law

11.1. This Website, these Terms and our Privacy Statement are governed by the laws of New Zealand.

11.2. We make no representation that this Website complies with laws (including intellectual property laws) of any country outside New Zealand. If you access this Website from outside New Zealand, you are responsible for ensuring compliance with all laws in the place where you are located.
